Se dejó sin valor ni efecto el auto interlocutorio proferido por el Juzgado respectivo, toda vez que la Corte constató que el poder concedido al abogado del demandado obra dentro del expediente en el folio 38, por lo tanto, existiendo el documento legalmente requerido para demostrar la sustitución de poder y llevar así la consecuente representación judicial, se desvirtuó completamente el argumento esgrimido por el mencionado Juzgado que en su momento señaló la ausencia de dicho documento dentro del expediente.

En consecuencia, se ordenó remitir el expediente a fin de que dé trámite a la impugnación elevada contra la sentencia proferida por el Juzgado de la referencia.

Primero. Dejar sin valor ni efecto el auto interlocutorio No. T-194 del 19 de junio de 1998, proferido por el Juzgado Civil del Circuito de Quibdo.
Segundo. ORDENAR que por Secretaria General de esta Corporacion se remita el presente expediente al Juzgado Civil del Circuito de Quibdo, a fin de que de tramite a la impugnacion elevada contra la sentencia proferida por el Juzgado
Primero. Civil Municipal de esa misma ciudad.
